Looks like the end of the road for Veropörssi and Satamedia…

A decision has come down finally from the High Administrative Court. (link in Finnish) The court decision reverses the Data Protection Board’s previous decision that magazines, websites, SMS services, etc. publishing and selling peoples’ taxation personal data is expression of freedom of the press or freedom of expression. (“sananvapaus” = literally freedom of the word) The court’s decision is by no means light entertainment if you want to try to read it, but I recommend it. Some news sites have already understood it to mean that Veropörssi and Satamedia publishing and selling taxation personal data is now illegal. The court decision also said things like the government should not be arbitrarily interfering in peoples’ private lives, and that peoples’ privacy should not be violated so that a certain group of people can satisfy their curiosity. Google makes pretty readable translations, if you want to try that.

    Shocking that they would actually side in favor of privacy. Then again, the tax authorities opened the door to that by not publishing the names of the poor.

    They’re probably just tying up loose ends so that the information of campaign contributors can be protected.

    But it still doesn’t change the fact, that the tax information will be publicly available, even by a newspaper. Its just you need to haul your ass in person to the tax office to make a query, or the information is a part of a journalist article. The SMS business and reselling the information most probably will be banned.

    Sounds awfully illogical to me, Hank, to have “public” information and forbid publishing it. It also sounds quite illogical to start arguing about what is journalistic use and what is not. Would Helsingin Sanomat’s top earner lists be journalism, but MTV3′s “Verokone” in the internet not? The most logical thing to do is to apply personal data protection to personal data. That clears everything up and makes it quite simple. I think that is the guidance the court is trying to give.

    #4 Did you actually read the verdict? It clearly states its not discussing publicity of tax records nor freedom of the press.

    Would Helsingin Sanomat’s top earner lists be journalism, but MTV3’s “Verokone” in the internet not? It depends, but you are making an assumption that this is something you wanted to hear when its actually not.

    So in other words, the verdict is on the resale and reuse of the public data – not on publicity nor publishing. That I’m afraid you need to wait until the cows come home (this only took what… 5 years?)

    @6 Nope, it’s not disucssing publicity of tax records, but it is discussion privacy protection.

    Wealth doesn’t help either, because the person who “runs the country” can live outside of the country. So his wealth isn’t known.
