Rape is legal in Finland

Wow, less than half of those convicted of rape ever serve jail time. Amazing…

According to a news report aired by the commercial television network Nelonen on Sunday, courts in Finland have been handing out relatively lenient sentences in cases of sexual assault – even in some which have led to physical injury.

Nelonen examined all sex crime cases handled by Finnish district courts over the past year and found out that prosecutors and courts have considered acts involving injury to the victim, or in which the woman’s home has been violently broken into, and even in which the victim has been kept a prisoner for several days, to meet the definition of “coercive sexual contact”, a category of sexual assault considered less serious than actual rape.

[...]The Nelonen report found that more than half of those convicted of actual rape have to serve real prison time. Less than one in ten of those convicted of the lesser crime have had to serve custodial sentences.

    Ya, the article doesn’t mention anything about the quality of proof in any of these cases. I suspect that in most it was her word against his. It should also be considered that “physical injury” could result from a domestic dispute due to a soured relationship. She might have even initiated the violence! Then the woman could claim “rape” for no other reason than to be vindictive.

    This type of dispute is very common in the drunken and often violent Finnish culture, especially in cases where the woman suspects the man of cheating on her. Judges know this very well.

    For these reasons, I don’t ascribe much credibility to such news pronouncements. We’ve heard them all before. Most often they are politically motivated, and at best attempt to amplify and project a small minority of possible ‘bad results’ onto the broader population of cases. They very rarely offer convincing evidence or examples of it being a real problem.

    I think the most important point in this was that the law is interested in the violence involved, and not so much in the ability of the victim to say yes or no, that is, it is not so important that the victim is unconscious, and so in no way consenting. That’s just sick, even though laws in other countries like Germany have the same outlook.

    Pertti, you made a very interesting comment. Do you think there is any way of getting better statistics on how convincing the rape cases are that get this lenient treatment? From what you say, this would be more informative of the real situation (i.e. the real number of cases of real rape that go un- or underpunished). By the way, how does this compare to similar leniency in other kinds of crimes?

    - As the ‘progressives’ attempt to move us all to that mythical ‘modern society’ they are going to have greater problems as more people opt out, causing problems for the rest of us.     For all the outrage poured out here, I cannot help wondering how many of you are for real.

    I thought this is a democratic country. And so, the laws are more or less agreed by the majority. So, either you guys are just all foreigners who cannot vote or are just chatting here for the sake of it.

    For this topic of rape-and-punishment and other “bizzare” court decisions, I have had numerous argument with Finns and foreigners alike. It can often turn into rather personal, even though the person has no experience of rape: not raped, no friends nor relatives raped before. I have to admit it is not as black-and-white a case, especially when you can afford such luxury to think and consider in a country like Finland.

    I tend to take it personal and think as if all the rapists would possibly come and rape my wife, my child or friends on day. So, all rapists should be castrated and locked up in a homosexual prison of the same sex.

    But then would it do the society any good? Rape is not a crime serious enough to put away a person for life, in most of the countries I know. When the rapist is released, would the punishment deter further crime? Or would such punishment deter rape crime in general anyway? Look at the US of A, where there are severe punishment, how does the crime rate look? Or look at South East Asia, where drug traffiking is a guarantee capital punishment, how is the crime rate going on?

    Certainly, if and when such misfortunate should happen to people close to me (I am a male by the way), I would probably never speak in such an objectivism. However, given such privilege, I might just as well take advantage of it. And I suppose this is also how the majority of the Finnish people have done, hence such laws and court decisions passed in regard to rape crime.

    If people are really upset about the crimes and angry at the laws, they sure would be changed by now. Likewise, if Finns (and many other European citizens) are really so against rape as a war weapon, genocides and using children as soldiers, there should have been much more decisive and definite actions earlier.

    It turns out democracy is not as democratic as it might suggest. Without the majority you are screwed. Minor numbers are almost like acceptable errors of statistics. And it is always far too easy just to sit back and whine among friends or in web forums.

    I understand that rape cases can be very difficult to prosecute especially in the cases where the individuals are acquainted in any way even if it’s one evening out. Women are also reluctant to come forward and take the stand on account of feeling like they themselves will be victimized again by the legal process. Lawyers have been known to drag a victim through the mud to try and disprove her case. Here in the US when a woman goes to a hospital to report she’s been raped there are “rape kits” that are used to collect evidence and it’s documented by the examiner. I would assume that alcohol is used as an “excuse” in many cases. I would think a toxicology panel would be run to check for levels of certain substances as well.

    What I don’t understand are lenient sentences. If someone is convicted of this heinous crime they should go to a maximum security PMITA facility for at least 20 years+. To rob is to steal someone’s property, to kill to steal someone’s life, to rape is to steal someone’s soul.

    I know and know of women and girls in Finland who have been raped, assulted, harassed and molested. Why don’t they or someone close to them report it I ask? Response either is “I don’t know”, “Nothing will happen anyway”, “Not my business”, or “They were drunk”

    In practise democracy is quite flawed, sadly.
    Almost everyone wants much less money to the politicians if not them to resign much often.
    The majority want harder sentences to the rapers which instead don’t even get fined… Who steals some bread goes to prison.

    I have no clue what happened to you, but clearly you have developed some sort of mental disease, and clearly the Finnish health care system is not going to be able to assist you.

    Why do I get the idea that you just like to see other people suffer, especially people who suffer through no fault of their own. You hate Americans and worse, you have a soft spot for tyrants who are the ones who do real damage around the globe.

    Every case of bad behavior done by an American is held up as the norm of our behavior. Bad behavior by Finns is ignored. Personal responsibility is ignored.

    You are real big in the internet, but I know your type. You are the type to see a woman being beat up in downtown Helsinki and just watch, figuring that it is too risky to try and stop it, and that she probably did something to deserve it. That is the difference between you and me. You will sit on your ass all day and blame your problems on everyone else. Me, I’ll go do something about it. Same with America. We are always doing. Sure it might not be the right thing, but is is surely better than doing nothing and then declaring victory as the whole planet goes down the tubes.

Especially about the Finns bad behaviour being generaly ignored or even excused and accepted here, while same time same behaviour performed by a foreigner gets national bashing from the Finns.     And there goes one more myth – equal rights of women. There is no rape in Finland, it’s a “casual sex with a total stranger”. It’s not a crime then,is it?

    A policeman was convicted raping a 15-year old. And now the court decided to reduce his punishment from 2.5 years jail time to 22 months conditional jail time (custodial sentence). Financial compensation to the victum was also reduced from 8000 euros down to 5000 euros
    One reason given for such reduction is that the violence used was minimal and the crime happened close to the “legal” age of 16-year old.

    All the 5 guys were convicted. For the 2 main guys convicted of serious child sexual assault, the court just (again) reduced the sentence from 5 years down to 2 years 10 months jail time.

    Man, this kind of sentence is also given to tax evasion convicts!
    I suppose it is not quite a system of lex talionis then.

    It looks as if some kind of insurance company case, that the victums also need to pay some “omavastuu”.
    Like “they should have tried to avoid being raped.”
    And the cases here are not just about rape, these are underage being raped.
    With such sentences, it is like pedopheliacs are getting a message that “if you want to rape little girls, get some 14 – 15 year-olds, not 12 or 13.

    I certainly for one would really want to see more appropriate punishment of such sex crimes. And I can see there has been a lot of angry discussions why there can such court decisions. However, this might be yet another Finnish behaviour that the politicians would not do a thing until things really get out of control or then these news get publicised by some foreign press.

    My heart goes out to all victims. I am a male and have been a victim of assault. Not anywhere near as what have been through. I was a corrections officer. I spent 12 hours a day surrounded by molesters, rapists, and others. It came to a point where I had toresign, because one day, I knew I would have a few people disappear. With that being said, For me, rape = murder. Why? Because it can kill the spirit or will to function, live and even think.
