Does Producer Timbaland rip off a song from Finnish musician Janne Suni..?

It is now claimed that Janne Suni a.k.a. Tempest a.k.a. Damage, a Finnish demoscene musician/graphic artist (who has also done cover art for Jyväskylä’s Rikos Records), has had ‘Acid Jazzed Evening’, one of his tracks, blatantly ripped by the well-known hip-hop/R&B producer Timbaland on Nelly Furtado’s song ‘Do It’ for her album Loose.
The said track is from a Commodore 64 conversion of an Amiga .mod file made by the Finnish demoscener Janne Suni. The track was entered into a music competition at Assembly 2000, a demo party held in Helsinki, Finland in the year 2000. Tempest’s entry ‘Acid Jazzed Evening’, a 4-channel Amiga .mod won first place in the “Oldskool Music” competition. According to Scene.org the song was uploaded to their servers in 2000, long before the release of the song by Furtado. A video which claims to show proof of the theft was posted to YouTube on January 12, 2007. It’s yet unknown whether Janne Suni will ever be able take the case to the court, the prospects of winning a court case against a major record label-backed international celebrity artist being very slight; not to talk about any astronomical expenses involved in losing a case like that.

Some of the catchiest melodies ever came from my Commodore 64. Anybody remember the theme music to “The Last Ninja”?
Jimmy Tamborello (AKA James Figurine AKA Figurine AKA Dntel AKA The Postal Serivce) samples alot of C64 sounds and uses them for songs. Good stuff!!

Well I’m not sure how this would be different in a stricter market, ripping off someone else’s music has nothing to do with political ideology.
But anyways – I love house & trance music, and in this genre there’s lots of remixing, sampling, and basically ripping off of other music, and I seriously doubt many of them have permission. But the difference is, it’s usually some broke guy ripping off the music, often from another broke guy. None of these house & trance musicians are real superstars, and none of these guys make much money at all if they rip off a song.

As songs are just intellectual property, and there is an infinite amount of copies of the Tempest’s songs still available, so there’s really no damage done, is there?
Or are you perhaps suggesting some intellectual property rights more important than others?

There was an artist a couple years ago, “Mighty Mouse” or something, he remixed The Beatles with Jay-Z in an album called “The Grey Album”. I don’t believe The Beatles nor Jay-Z received any royalties. Of course, he at least made it known that it was Jay-Z and The Beatles whom he was remixing. If he would have had paid royalities, the album would never had been made, cause he’d probably never be able to afford it or get permission in the first place.
So, I don’t have a problem with remixing, I’m not sure Tempest should receive any $$ for this. I think this public outcry and ostracizing that we’re seeing is a good way to handle the situation.

Actually, the practice of stealing another person’s IP is very socialist. Claiming the stolen work as your own and charging big $$$ for it, as well as employing an army of lawyers to make sure that the other guy has a snowball’s chance in hell of winning a lawsuit is very capitalist.
Only artists endorsed by the music industry oligopoly should be making money from music. This is in line with libertarian ideals.

That is pretty dumb to say. What if I took some Timbalands song 1:1, add new vocals/whatever add sold it as mine? They would sue in a day. There is copyright laws for a reason.

There’s nothing wrong with borrowing other peoples music and remixing them as long as you acknowledge their contribution and give them credit for it. Stealing other peoples work and presenting it as your own is not remixing.

What do you expect from a remixer? They haven’t the talent to write music themselves so they just steal it from others. Good luck to all involved and take Timbaland to the cleaners.
