Filed under: Uncategorized — Phil @ 6:15 pm

Radio Free Finland, my new weekly online radio show, announced its first guest. Here’s a hint: He’s a lawyer specializing in IT-law, he’s co-founder of EFFI (Electronic Frontier Finland), and he was recently threatened with an 80,000 euro lawsuit from fancy Helsinki restaurant

Visit the Radio Free Finland site for the details!! Tune in this Sunday night at 10pm (Finnish Time - 3pm EST) for the live interview, send in your questions to be read on the air, or if you have a microphone and Skype, you can chat live with our guest.

  1. Regarding the horrendous attack on the freedom of speech: I’m beginning to side with Lehtovaara on this, just because Herkko and his company seem like like bunch of pretentious yuppie snobs who should know their place and stick to SK-Ravintolat. Restaurants have the right to choose their clients.

  2. So you think people should get sued for tens of thousands of euros, just because they wrote a bad review of a restaurant online??

So you think people should get sued for tens of thousands of euros, just because they wrote a bad review of a restaurant online??

Hey, isn’t the suing industry the basis of the Holy American Economy, the one that Finnblunder and buddies say we should emulate?

  4. Hey, isn’t the suing industry the basis of the Holy American Economy, the one that Finnblunder and buddies say we should emulate?

Yes, it was a very “American” move by the restaurant to sue. Although under a libertarian government, this case would never see the light of day. People have a right to free speech.

How silly to think that this case has anything to do with free speech. For what it’s worth, free speech doesn’t cover e.g. slander, libel or hate speech. Of course, libertarians sure love them all.

  6. That’s where you and I differ, I believe free speech does cover slander, libel and hate speech. Even if it didn’t, Herkko Hietanen would still be in the clear, he did no such libel.

  7. I believe free speech does cover slander, libel and hate speech.

The Finnish law disagrees with you. Btw, do you think it also covers yelling “Fire!” in a full theatre?

Herkko Hietanen would still be in the clear, he did no such libel.

Sure, but certainly you don’t want to limit the restaurant’s God-given right to sue everyone and everything in sight?

  8. The Finnish law disagrees with you.

That’s true, and as a strong believer in the freedom of speech, I’d like to see it changed here and in the U.S.

Btw, do you think it also covers yelling “Fire!” in a full theatre?

A theatre is private property. It’s up to the owners whether or not you can yell “fire” or not.

Sure, but certainly you don’t want to limit the restaurant’s God-given right to sue everyone and everything in sight?

Well I guess they can sue all they want, but a judge better be there to quickly throw the case out of court and the restaurant to pay for all the fees.

  9. That’s true, and as a strong believer in the freedom of speech, I’d like to see it changed here and in the U.S.

And what particular purpose would it serve to allow hate speech?

    A theatre is private property.

Really now? Such as the Helsinki City Theatre?

It’s up to the owners whether or not you can yell “fire” or not.

Since the city streets are owned by the city, then I suppose the city can impose arbitrary restrictions on your freedom of speech (or anything else, for that matter) while you’re walking on them.

  10. Has the name of this podcast been influenced by a certain Canadian tv-series by any chance? Or is it just my inner teen-movie and -TV fanatic that thinks so?

    Comment by Anzi — Fri, Sep 2nd, 2005 @ 12:00 pm

  11. And what particular purpose would it serve to allow hate speech?

Since when should it be illegal for hating people? The idea of the “thought police” scares me. It’s a slippery slope.

Really now? Such as the Helsinki City Theatre?

Well someone certainly manages it and is responsible for it. Just because it’s funded with my taxpayer money, doesn’t mean I get any say in what goes on there.

Since the city streets are owned by the city, then I suppose the city can impose arbitrary restrictions on your freedom of speech (or anything else, for that matter) while you’re walking on them.

So we should lock up all the crazies downtown for some bullshit that comes out of their mouths? Let them yell “fire” all they want.

  12. Has the name of this podcast been influenced by a certain Canadian tv-series by any chance?

Nah, just from “Radio Free Europe” is where I got the name.

Now here’s the real trivia: See if you can find out where i snagged that “speaker” logo from.

    Comment by Phil — Fri, Sep 2nd, 2005 @ 1:53 pm

  13. Since when should it be illegal for hating people? The idea of the “thought police” scares me. It’s a slippery slope.

Since when was hating anyone illegal? It is very specifically public aggravation against a group of people that is illegal in Finland. You may rant about them goddamn [insert your favourite racial slur] over a pint in the local suburbian räkälä all you want, but the minute you publish a book about it, you get charged. And that’s the way I like it. And no, this has nothing to do with a “thought police”.

By the way, the “slippery slope” is usually categorised as a logical fallacy in the “argumentation analysis” so very much favoured by libertarians.
